TED RUSSELL AUCTION TERMS AND CONDITIONS

REGISTRATION FREE: $25

BUYER PREMIUM: Auction fees range from $115.00-$315.00

BIDDER REGISTRATION

Bidder must be registred with Ted Russell Auction in order to place bid. Bids will not be accepted from non-registered bidders. There is no charge to register as a bidder. The auction fees applies to all bidders. Bidders may register on the day of the auction.

PAYMENT

BUYERS: Payment will be accepted as follows: Cash, Cashiers Check. Payment must be made at the on site auction office within one hour of the sale ending.

SELLER: Sellers will be issued an auction company check for the Bid Amount. Checks will only be issued if and when transferable title has been received and the bidder has settled with the Auction Co. with Guaranteed funds.

TITLES

SELLERS: MUST SUBMIT CLEAR TRANSFERABLE TITLE TO THE AUCTION OFFICE, UPON ARRIVAL AT THE AUCTION.

BUYERS: Titles will be mailed to you within 14 days of auction.

NOTICES

• SALES MADE PRIOR TO THE AUCTION ARE SUBJECT TO ALL SALES AND BUYERS FEES.
• BIDDERS PERFORMANCE CAN NOT BE GUARANTEED; HOWEVER WE WILL MAKE EVERY EFFORT TO COMPLETE THE SALE ON THE SELLERS BEHALF.
• BUYERS MUST SETTLE WITH THE AUCTION OFFICE WITH-IN ON HOUR OF SALE ENDING.
• THE AUCTION WILL HAVE DRIVERS TO TAKE YOUR CARE ACROSS THE BLOCK.
• ALL CARS SOLD AS IN WHERE IS. ANY GUARANTEES WRITTEN OR IMPLIED TO THE AUTHENTICITY, CONDITION, OR ORGINALITY OF THE VEHICLE ARE THAT OF THE SELLER AND NOT THAT OF THE AUCTION CO. THE AUCTION CO. WILL NOT GUARANTEE “MATCHING NUMBERS”.
• ALL BIDS ARE FINAL! IF YOU ARE AWARDED THE FINAL BID, YOU OWN THE MERCHANDISE AND ARE RESONSIBLE FOR PAYMENT IN FULL WITHIN ONE HOUR.
• TENNESSEE RESIDENTS MUST PAY ALL APPICABLE TAXES TO THE AUCTION CO.

Seller agrees that all items are SOLD TO HIGHEST BIDDER, UNLESS STATED ABOVE!!! Seller must present at auction to represent items being sold.

Limitation of Auctioneer & Auction Company Liability. Auctioneer & Auction Company shall have no liability or obligation to Owner or any other person, firm, or corporation with respect to said auction sale or the Owner’s property, Except as is specifically set forth in this agreement, and Owner agrees to indemnify and hold Auctioneer & Auction Company harmless from any and all claims and demands from and person, firm or corporation (including court costs and attorney fees) brought for any reason.

        It is also expressly agreed and understood that Auctioneer  Auction Company does not guarantee performance by the high bidder, and therefore, shall not be responsible if, for any reason the high bidder shall refuse to perform his agreement to purchase.

        Seller further agrees that upon Auctioneer & Auction Company discretion refunds shall be made on any item(s) misrepresented by seller either intentionally or unintentionally. Seller shall upon notification of such refund reimburse Auctioneer & Auction Company to the extent of said refund. Seller further agrees that should they fail to reimburse Auctioneer & Auction Company they assume responsibility for all court cost and attorney fees brought forth by Auctioneer & Auction Company.

Condition. Seller must note any known defects of items listed.

Miscellaneous. Owner agrees that no item of personal property described in this agreement shall be sold until the day of the auction sale herein provided for, without the written consent of the Auctioneer. In any event any of the Owner’s property is so sold prior to the auction sale by the Owner, the Owner shall pay the Auctioneer the commission rate set forth in this contract.

        In the event that the Owner withdraws any item of personal property from the auction, the Auctioneer is due his full commission rate as set out in this agreement base on the fair market value of the property withdrawn. Seller agrees to pay Auctioneer for its services in conducting said auction sale of the above listed items. The last bid made or received, said commission to be due and payable of auction within 1 hour of Auction ending.

        I commission you to sell listed item to the highest bidder by public auction. I certify that I am the owner of the listed goods, merchandise, and or property and have good title and the right to sell and that they are free from all encumbrances. Auctioneers / Auction not responsible for items lost, damaged, or stolen. Seller agrees to insure their property. I agree to hold harmless the Auctioneers / Auction against any claims of the nature referred to in this agreement.
